Hi! Robert,
The purpose of this letter is for better communication and negotiation, and to deliver the voice of all the Shanghai employees to the Company. We sincerely hope that both the Company and the employees can get through this tough period successfully and peacefully.
Just as the five-year- ago “911” happened in the U.S, the damage and impact to the American people still over there, the decision of Shanghai factory shut-down could also be a disaster and shock to both 1240 Shanghai employees and our families. We hope the Company and each employee will recover from this crisis as soon as possible. For our Powerwave, the ultimate destiny is to get through the great pain of the consolidation and grow to be the most outstanding enterprise in the world. However, for most of the Shanghai employees, we will have three-month job loss, which is a tough ordeal we have to face.
After the communication of all Shanghai employees, we all strongly believe that the compensation solution of N+3 is very reasonable. The reason is as bellows:
1, The most important Chinese Spring Festival is coming after the following three months, the toughest period for job hunting. Just as the Thanksgiving Day, which has just passed by not long ago, we expect that we can also appease our families and ourselves with an indebted heart.
2, The foreign company in China and the local company with same crisis always provide N+3 compensation solution for such compensation. For instance: HP and IBM compensated N+6,even N+7;one foreign-owned company in Suzhou compensated 6 months salary; Chinese enterprise Lenovo compensated N+3.
3, N+1 is only the lowest compensation standard regulated by China’s law. However, it is not so appropriate to our company’s strength and the Company’s sprit of concerning and caring each employee. Bob’s announcement meeting openly expressed that for successful Shanghai factory transfer, the Company will not concern the financial load and will compensate the employee as much as possible. The lowest compensation standard is definitely against such spirit. The only two-month difference of N+3 and N+1 cannot be the unbearable reason for our company. The shanghai employee’s salary sum is almost nothing compared with the task of successful product transfer.
We conclude out the N+3 compensation solution after discussion and strongly believe the Company will accept our reasonable and appropriate proposal.
Attached is the signature of 1000 shanghai employees (80% of the whole Shanghai Company employee) for the proposed compensation solution.
We hope we can get through such crisis as much as possible with the support of the Global, and we wish all of you American colleagues happy Christmas!

与5年前的911一样,911对美国民众造成的伤害至今还在,而公司宣布关闭上海公司的决定,对于我们1240名上海员工,以及我们的家人来说,都是灾难性打击,是 shock。希望我们公司和我们每个员工都能尽快从这次危机中恢复过来,对与我们powerwave公司来说,最终的命运是经过重组的阵痛后成长为全球瞩目的企业,而对于我们绝大多数上海员工来说,3个月失业以及长时间的失业是不得不面临的严峻考验。
我们全体上海员工经过协商,大家统一认为,N+3的补偿方式是合理的补偿方式,原因如下:
1, 接下来的三个月内,我们将迎来中国人最重要的节日,农历新年。这是传统意义上就业机会最少的时期。与美国人民刚刚过去不久的感恩节一样,我们期待着,在我们的节日里也能怀着感恩的心情去安抚我们的家人以及我们自己。
2, 曾发生过类似危机的在华的外国以及本国企业在处理这样的补偿时,补偿方案通常是N+3,例如,HP以及IBM的补偿为N+6,甚至N+7,在我们公司新的工作地点,苏州一家外国投资的企业,其补偿方案为6个月。中国的企业联想,补偿同样为N+3。
3, 中国法律规定的N+1为补偿的最低线,我们认为,这与我们公司的实力以及所能对我们的表现的人文关怀是不相称的,在BOB的announce里,明确指出,为了顺利的实施工厂的搬移计划,公司在对员工的补偿方案不考虑财务负担,以为员工争取最大的补偿,这与最低的补偿标准的实施是背道而驰的。我们所要求的N+3与中国法律规定的N+1对公司来说,仅仅是两个月的差额,这不应成为公司难以承受的理由。上海全体员工的每月工资总和与公司顺利完成转移相比是微不足道的。
上海全体员工在经过全体协商后达成N+3的补偿要求,我们相信公司会支持我们合理的诉求。
随信附上部分上海员工的对于我们的补偿方案的签名,共1000名员工签名,占全部员工总数的80%。
希望在全体上海员工以美国方面的支持下,我们早日度过危机,预祝全体美国员工圣诞节快乐。
